EASTERN CAPE – The Priority Crime Specialised Investigation (PCSI) team of the Hawks in conjunction with National Prosecuting Authority (NPA) Asset Forfeiture Unit successfully applied for the forfeiture of assets accumulated fraudulently and those seized as instrumentality during the commission of a crime and thus reimburse the victims.
In July 2019, a complainant was scammed of R83 000 that he paid towards the purchase of a vehicle seen on the OLX platform. Swift action by the Hawks caused the receiving account to be frozen. The preservation order followed by the forfeiture order was granted by the High court and the victim could subsequently be paid back an amount more than R72 000.
In September 2019, a case was opened where it was reported that on various occasions it occurred that requests for payments were submitted to the Department of Education for accommodation and other related costs. It was however established that double payments were made for the same services. The subsequent financial flow investigation identified a stand in Cathcart purchased with these funds siphoned from the department. The preservation and forfeiture order were granted by the High court. The value of the forfeiture order is R880 000.The plot will be sold and the funds to be deposited in the Current Asset Recovery Account (CARA) of the State.
During June 2021, a total of 6 suspects were arrested transporting abalone upon which a VW Caddy motor vehicle which was seized as instrumentality in the commission of this crime. A preservation and later a forfeiture order was obtained. The said vehicle valued at R135 000 is to be auctioned and the funds to be deposited to CARA.
In another incident reported in August 2017, two individuals were in business together, when it was discovered that one of the business partners, who was later arrested, misappropriated business funds. Subsequent action led to the recovery of more than R355 000 which was paid back to the victim as per court order.
The Provincial Head, Major General Mboiki Obed Ngwenya commended the joint efforts by PCSI and NPA Asset Forfeiture Unit for the sterling job ensuring that vulnerable victims are reimbursed and criminals do not get away with their fraudulent activities.
